Frequently Asked Questions

Please reach us at info@serveittoday.com if you cannot find an answer to your question.

  • Serve It Today is a process serving company that provides legal support services to law firms, attorneys, and businesses.

  • Serve It Today offers various services such as process serving, court filing and e-filing, document retrieval and application preparation for self-representatives.

  • A process server is a title given to a legal officer, court official, firm, or individual responsible for delivering legal documents to a person involved in a legal proceeding. The role of a process server can vary by jurisdiction but often includes tasks such as filing court papers, collecting legal documents, and carrying out the service of process.
  • Following the completion of their task, process servers are required to provide verification that the legal documents were properly handed over to the intended recipient. This verification, known as an Affidavit of Service, confirms that the papers were either directly served to the right person or appropriately delivered to a suitable substitute.

  • A professional process server may visit you or your home multiple times in order to serve you with legal documents. They will continue to make attempts until the papers have been delivered and you have acknowledged receipt of them. In Toronto, the process server is allowed three attempts to serve the documents. If they are unsuccessful, the applicant can request alternative service from the court.

  • The primary responsibility of a process server is to deliver legal documents, such as court summonses or Statements of Claim, to the defendant or other relevant party involved in a case. This must be done within the boundaries of the law in the jurisdiction where the service is taking place. The process server is permitted to personally hand the documents to the defendant or to sub-serve by delivering them to someone in the same household or business as the defendant.

  • However, if the recipient is avoiding the process server, the documents can be left in close proximity to them. This sub-serving person must be at least 18 years old. Once the delivery is complete, the process server is authorized to provide a notarized proof of service to the court or the party requesting the service. Upon completion of the service, the process server must return to the court and file an Affidavit of Service or Proof of Service form.
